Introduction

These Terms of Service ("Terms") govern your use of the Wavelink website (https://wavelinkinternet.com) and any related applications, services, or tools (collectively, the "Services") operated by Wavelink Communications, LLC ("Wavelink," "we," "our," or "us"). By accessing or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree with any portion of these Terms, please discontinue use of our Services immediately.

Age Restrictions

Our Services are intended for users who are at least 16 years old. If you are under 16, you may use the Services only under the supervision of a parent or guardian who agrees to be bound by these Terms. Wavelink does not knowingly collect or solicit personal data from individuals under 16. If we learn that we have inadvertently collected such information, we will promptly delete it from our records.

Changes to the Terms

We reserve the right to modify or update these Terms at any time. Changes become effective upon posting the revised Terms on our website. If you have an account with us, we may also notify you by email of any material changes. By continuing to use our Services after new Terms are posted, you agree to be bound by the updated Terms.

Website Access and Availability

We aim to keep our Services accessible at all times. We do not guarantee uninterrupted or error-free functionality. We may update, remove, or disable certain features without prior notice. You agree that we are not liable for any disruption, downtime, or failure of the Services. You are responsible for ensuring you have the proper equipment and internet connection to access and use the Services.

Account Security and Responsibility

To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information when necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. If you suspect unauthorized access or use of your account, notify us immediately at hello@wavelinkinternet.com. We reserve the right to terminate or suspend your account if we believe you are violating these Terms or any applicable law.

Intellectual Property

All text, graphics, logos, icons, images, software, and other content on the Services (the "Content") is owned or licensed by Wavelink, unless otherwise noted. You may view and print pages from our Services for personal, non-commercial use. Any other usage, including reproduction, modification, or distribution of the Content, requires our prior written consent. Unauthorized use of our Content may violate intellectual property laws and could lead to legal action. Nothing in these Terms grants a license to use any trademark, service mark, or logo displayed within our Services without written permission from the respective owner.

Products and Services Availability

Certain products, internet packages, or promotions ("Offerings") may be displayed on our Services. We reserve the right to limit or discontinue any Offering without notice. Display of an Offering does not guarantee availability. If we accept your order for any Offering, we will confirm through email or another method. We may cancel or refuse orders at our discretion, even after an order confirmation.

Pricing and Payment Details

All prices shown on our Services are subject to change without notice. We strive to ensure accurate pricing, but may correct inadvertent errors. If a product or service is listed at an incorrect price, we reserve the right to cancel orders placed for that item and to issue a refund or request the correct payment amount. By making a purchase, you agree to pay all applicable fees and taxes.

Access and Use Permissions

We grant you a limited, non-exclusive, and revocable license to access and use our Services for their intended purposes, as long as you comply with these Terms. You agree not to:

  • Resell, rent, or lease the Services to any third party.
  • Attempt to reverse-engineer or extract source code from the Services.
  • Use the Services for any unlawful activity or in violation of any applicable laws or regulations.
  • Interfere with the security or performance of the Services, including distributing malicious software.

Devices and Hardware Ownership

Customers must either purchase or rent a Wavelink device to use the Service. Available options include devices designed for home use, business use, and portable devices for on-the-go connectivity. Devices that are rented are owned by Wavelink Communications, LLC. Customers are permitted to use these rented devices while they maintain an active service contract. Upon service termination for any reason, rented devices must be returned to Wavelink using return labels provided by us. Customers are financially responsible for replacing any returned devices that are damaged or not returned. Devices that are purchased become the property of the customer. However, purchased devices are still subject to compatibility and technical support limitations as outlined by Wavelink.

Customer Responsibilities for Installation or Use

Customers are responsible for ensuring they have compatible devices and a safe installation environment that does not interfere with the delivery of service. While our Services are designed to be easily installed by users with guidance from our resources, support is available if needed. Customers can email activations@wavelinkinternet.com to schedule a quickstart activation call. Backup internet add-ons are intended for emergency or supplemental use and are not a replacement for your primary connection. Each plan is subject to a $2.99 monthly regulatory fee. Mobile providers we connect to are AT&T, T-Mobile, and Verizon.

Account Inactivity and Deletion

Accounts that remain unused (no logins or activity) for six consecutive months may be deemed inactive. We reserve the right to terminate or delete such accounts to maintain an efficient system. This rule does not apply to accounts that have made prior purchases of Services or subscriptions, which will remain active unless otherwise requested by the account owner.

Trademark Guidelines

"Wavelink" and our associated logos are trademarks or service marks of Wavelink Communications, LLC. You must not use these marks without our express written authorization. All other names, brands, and marks appearing on the Services are the property of their respective owners.

Subscriptions and Renewals

We may offer subscription-based Services. Unless otherwise specified, subscriptions automatically renew at the end of each billing cycle. If you wish to cancel, you must do so before the renewal date to avoid subsequent charges. Subscriptions are subject to these Terms and any additional policies outlined at the time of purchase.

Trial Period Policy

We may provide a free or discounted trial of certain paid Services ("Trial Period") for a total of seven (7) days after the order is placed. If you do not cancel before the Trial Period ends, you will be automatically enrolled in the paid Service. We reserve the right to revoke trial access in cases of suspected misuse or violation of these Terms.

Refund Policy

Unless explicitly stated otherwise, all fees for our products and Services are non-refundable. In exceptional cases, and at our sole discretion, we may grant refunds. If a refund is issued, your access to the applicable Service may be terminated immediately. To inquire about refunds, please contact billing@wavelinkinternet.com.

Prohibited Uses

You agree not to use the Services to:

  • Violate any law, regulation, or third-party rights (including intellectual property or privacy rights).
  • Engage in unauthorized advertising, spam, or transmitting viruses, worms, or other harmful code.
  • Impersonate any individual or entity or misrepresent your affiliation with a person or organization.
  • Conduct activities that interfere with or disrupt the integrity or performance of our Services or related systems.
  • Collect personal information about other users without their consent.

Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. Wavelink disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any defects will be corrected.

Limitation of Liability

To the fullest extent permitted by law, Wavelink and its affiliates, employees, directors, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, nor for any lost profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Services.

Indemnification

You agree to defend, indemnify, and hold harmless Wavelink, its affiliates, and their respective employees, officers, directors, and agents from and against all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorneys’ fees) arising from your use of the Services or your violation of these Terms.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any claim or dispute arising from these Terms or the Services shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.
